Trade mark practice guideline amendment 2006/10 – slogans

Published: 05.12.2006

IPONZ has received a number of requests from clients asking for clarification of its practice surrounding marks comprised of slogans or promotional language.

IPONZ has reviewed and clarified its practice in light of court and hearings decisions in New Zealand and in light of international best practice to ensure that such marks are treated consistently.

As a result, section 6.4 of the Practice Guidelines on Absolute Grounds: Distinctiveness has been amended.

A full version of the above new practice guideline is available at www.iponz.govt.nz select “Information Library” | “02. Trade Marks” | “3 Trade Mark Practice Guidelines” | “Trade Marks Act 2002”.
